Legal Director - Institute for Constitutional Advocacy and Protection (ICAP) - Georgetown University Law Center

The mission of Georgetown Law’s Institute for Constitutional Advocacy and Protection (ICAP) (https://www.law.georgetown.edu/icap/) is to use the power of the courts to defend American constitutional rights and values. ICAP draws on expert litigators, novel litigation strategy, and the constitutional scholarship of Georgetown to vindicate individuals’ rights and protect America’s constitutional way of life.

Job Overview

The ICAP Legal Director provides leadership, strategic development, and administrative management to support ICAP’s overall operations – and meets their responsibilities by employing diverse litigation and policy experience, exceptional legal and writing abilities, and top-notch management skills.

In furtherance of ICAP’s core activities, and in conjunction with ICAP’s Executive Director and Supreme Court Director, the Legal Director guides ICAP’s team of attorneys in identifying opportunities for, and then developing and executing, litigation and policy strategies in cases at all levels of the courts (state and federal; trial and appellate) and in government. Specifically, they:

  • Provide strategic direction regarding when litigation and/or policy development provides a promising mechanism for pursuing the defense of constitutional rights

  • Take a lead role in developing legal theories and policy strategies to meet both urgent and emerging needs

  • Oversee complex, fast-moving, high-impact litigation in defense of constitutional rights and values, from brainstorming through drafting and reviewing briefs and engaging in oral argument;

  • Build relationships with partner organizations and potential clients for litigation and policy initiatives

  • Teach (alongside the Executive Director and Supreme Court Director) ICAP’s Constitutional Impact Litigation practicum-seminar each semester and ensure that Georgetown Law students are meaningfully and materially integrated into ICAP’s litigation and policy efforts; and

  • Speak and write for non-attorney audiences to support ICAP’s core goals

The ICAP Legal Director draws on their own litigation, policy, and management experience to help oversee ICAP’s overall efforts, including supervising ICAP’s attorneys, practicum students, and summer interns.

Work Interactions

Reporting to the ICAP Executive Director, the ICAP Legal Director works loosely with the Executive Director and the Supreme Court Director to manage and guide all of ICAP’s work. Interactions include but are not limited to:

  • Along with the Executive Director, the Legal Director supervises ICAP’s staff attorneys, office manager, and litigation assistant to further ICAP’s litigation and policy efforts

  • The Legal Director coordinates with ICAP’s co-counsel, collaborates with non-profit partner organizations, and serves as a primary point of contact for ICAP’s grant funders.

  • The Legal Director interacts with Georgetown Law faculty supporting ICAP’s work and teaches and supervises law students participating in the practicum and summer interns.

  • The Legal Director serves as a primary liaison between ICAP and Georgetown’s administrative offices and have responsibility for ICAP’s human resources, cost center management, and grants administration functions.

All told, the Legal Director plays an essential role in fulfilling ICAP's mission of harnessing the talent and expertise of ICAP’s team, Georgetown Law's faculty, and its students in designing and effectuating strategically selected, complex constitutional litigation and innovative policy on cutting-edge issues and exposing the law school community, including students in the ICAP practicum, to this work in meaningful ways.

Sponsored Project Management

As the designated Department Financial Manager for Sponsored Project, the ICAP Legal Director is responsible for financial management of the sponsored project to ensure compliance with sponsor’s requirements and University’s policies and procedures. Within 30 days after the close of the month (generally the 8th business day after the end of the month), the duties to be performed by the employee include, but not limited to:

  • Review and reconcile expenses on the Center Status Reports to ensure that the expenses are a) allowable by the sponsor for the project, b) allocable to the project, c) reasonable and necessary, d) supported by required documents, and e) within the budgeted amounts;

  • Review salary distributions to ensure that they reasonably reflect employees’ level of effort on project. Review associated fringe benefits for accuracy;

  • Review the commitments of key personnel, to ensure the costs reasonably reflect the level of effort committed to the sponsors as part of proposal and notify OSP/OSR of significant variances;

  • Review the calculation of indirect cost recovery to ensure accuracy;

  • Process all corrections and adjustments within 90 days of when the charge initially posts to the financial system (posted date for non-payroll and pay period end date for payroll transactions) and ensure corrections and adjustments are reviewed and approved according to the signature authority policy and supported by appropriate documents;

  • Complete the Financial Status Report (FSR) worksheets timely and accurately; and

  • Ensure that payments to subrecipients are reviewed and processed in a timely manner.

Requirements and Qualifications

  • J.D.

  • Experience teaching and/or supervising students or supervising other attorneys - preference for at least 10 years of experience in legal work after law school, including federal court clerkships, experience in impact litigation, and/or legal policy experience

  • Demonstrated ability to develop and implement innovative litigation and/or policy strategies

  • Commitment to promoting a sense of belonging and contributing to an equitable and inclusive learning and working environment
